{"id":2370,"date":"2019-02-07T00:00:00","date_gmt":"2019-02-07T02:00:00","guid":{"rendered":"https:\/\/marinsbertoldi.com.br\/a-nova-lei-do-distrato\/"},"modified":"2019-02-07T00:00:00","modified_gmt":"2019-02-07T02:00:00","slug":"a-nova-lei-do-distrato","status":"publish","type":"post","link":"https:\/\/marinsbertoldi.com.br\/en\/a-nova-lei-do-distrato\/","title":{"rendered":"A nova lei do distrato"},"content":{"rendered":"<p><strong><em>A Lei n\u00ba 13.786\/2018 trouxe importantes novidades na resolu\u00e7\u00e3o de contratos que&nbsp;<\/em><\/strong><strong><em>versem sobre a compra e venda de im\u00f3vel.<\/em><\/strong><\/p>\n<p>Uma das principais mudan\u00e7as consiste na obrigatoriedade de inser\u00e7\u00e3o de quadro resumo nos contratos de compra e venda, promessa de venda e&nbsp;cess\u00e3o contendo as principais informa\u00e7\u00f5es do contrato, tais como o pre\u00e7o&nbsp;total do&nbsp; m\u00f3vel, prazo de entrega, taxas e \u00edndices de corre\u00e7\u00e3o, forma de pagamento,&nbsp;possibilidade de exerc\u00edcio de direito de arrependimento, eventuais&nbsp;\u00f4nus que recaiam sobre o im\u00f3vel e o termo final para obten\u00e7\u00e3o do auto de&nbsp;conclus\u00e3o da obra (habite-se), entre outras previstas na nova lei.<\/p>\n<p>De acordo com as novas regras, fica oficialmente permitida a reten\u00e7\u00e3o de parte dos valores j\u00e1 pagos pelo adquirente do im\u00f3vel se a rescis\u00e3o for provocada por&nbsp;este sem motiva\u00e7\u00e3o, bem como da comiss\u00e3o de corretagem, taxa de frui\u00e7\u00e3o do&nbsp;im\u00f3vel e outros encargos previstos no contrato.<\/p>\n<p>Caso n\u00e3o sejam atendidos todos os requisitos que a nova lei exige, a incorporadora\/construtora ter\u00e1 que aditar os contratos firmados na vig\u00eancia da nova&nbsp;legisla\u00e7\u00e3o no prazo de 30 dias contados a partir da data de assinatura, sob pena&nbsp;de rescis\u00e3o justa e motivada do contrato pelo adquirente, sem direito de&nbsp;qualquer reten\u00e7\u00e3o de valores.<\/p>\n<p>Portanto, \u00e9 de suma import\u00e2ncia que incorporadores\/construtores adequem&nbsp;seus modelos de contrato aos termos da nova lei, evitando assim as penalidades&nbsp;nela previstas.<\/p>\n<p>&nbsp;<\/p>\n<p><em><strong>Quesia Marmachuk Gon\u00e7alves<\/strong><\/em><\/p>\n<p><em><strong>N\u00facleo Corporativo<\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Lei n\u00ba 13.786\/2018 trouxe importantes novidades na resolu\u00e7\u00e3o de contratos que&nbsp;versem sobre a compra e venda de im\u00f3vel.
