No Tema 816, o Supremo decidir\u00e1 acerca da incid\u00eancia do ISSQN em opera\u00e7\u00e3o de industrializa\u00e7\u00e3o por encomenda, realizada em materiais fornecidos pelo contratante, quando referida opera\u00e7\u00e3o configura etapa intermedi\u00e1ria do ciclo produtivo de mercadoria, bem como acerca dos limites para a fixa\u00e7\u00e3o da multa fiscal morat\u00f3ria, tendo em vista a veda\u00e7\u00e3o constitucional ao efeito confiscat\u00f3rio.<\/p>\n
J\u00e1 no Tema 985, o STF julgar\u00e1 os embargos de declara\u00e7\u00e3o opostos em face do ac\u00f3rd\u00e3o paradigma, que havia reconhecido a constitucionalidade da incid\u00eancia de contribui\u00e7\u00e3o previdenci\u00e1ria sobre o ter\u00e7o constitucional de f\u00e9rias gozadas, para fins de incid\u00eancia da contribui\u00e7\u00e3o previdenci\u00e1ria patronal.<\/p>\n
