To comply with current legislation, Marins Bertoldi has ensured that our operations are in line with the General Data Protection Law (LGPD) – Law No. 13.709, dated August 14, 2018. Your data privacy is important to us, so we have reinforced our IT security procedures and adjusted the protection of personal data during processing as required by law.

Data Subjects' Rights
The LGPD includes, in Articles 18, 19, and 20, the rights of data subjects:
The ownership of your personal data and the guarantee of fundamental rights of freedom, intimacy, and privacy;
Obtain from Marins Bertoldi at any time and upon request:
- Confirmation of the existence of processing;
- Access to the data;
- Easy access to information about the processing of your data;
- Correction of incomplete, inaccurate, or outdated data;
- Anonymization, blocking, or deletion of unnecessary, excessive, or non-compliant data with the provisions of the Law;
- Portability of data to another service or product provider, upon express request, in accordance with national authority regulations, subject to commercial and industrial secrets;
- Deletion of personal data processed with the data subject’s consent, except in cases provided for in Article 16 of the Law;
- Information about public and private entities with which the controller has shared data use;
- Information about the possibility of not providing consent and the consequences of refusal, under the terms of § 5 of Article 8 of the Law;
- Petition regarding your data against the controller before the national authority;
- Object to processing carried out based on one of the consent exemption hypotheses, in case of non-compliance with the Law’s provisions;
- Storage in a format that favors the exercise of the right of access;
- Provision of information and data by electronic means, secure and suitable or in printed form, at the data subject’s discretion;
- Having the processing based on the data subject’s consent or contract, the data subject may request a full electronic copy of their personal data, subject to commercial and industrial secrets, under national authority regulations, in a format that allows its subsequent use, including in other processing operations;
- Request the review of decisions made solely based on automated processing of personal data that affect their interests, including decisions aimed at defining their personal, professional, consumer, and credit profile or aspects of their personality;
- Request that, when the processing is based on the controller’s legitimate interest, only strictly necessary personal data for the intended purpose be processed.
Data Subjects' Rights
Marins Bertoldi has a data subject assistance channel to ensure the effective exercise of the aforementioned rights. Requests must be sent by the data subject or a legally constituted representative and will be answered at no cost within 15 days from the date of the request, as stipulated in the regulation.
If the data subject’s request concerns the confirmation of the existence or access to personal data, the DPO may respond as follows:
- In a simplified format, immediately; or
- By means of a clear and complete statement indicating the origin of the data, the absence of a record, the criteria used, and the purpose of the processing, subject to commercial and industrial secrets.
In this channel, Marins Bertoldi may, in case of inability to immediately adopt the requested measure by the data subject, as indicated in Article 18, § 4, I and II:
- Inform that it is not the data processing agent and indicate, whenever possible, the agent;
- Indicate the factual or legal reasons that prevent the immediate adoption of the measure.
